Sheriff’s deputies arrested Jimmy Lee Hostmark, 52, resident of Crestline for criminal threats after he allegedly threatened a neighbor with death on October 28.
In a statement to The Alpenhorn News by a Sheriff’s Department spokesperson, the Sheriff’s Department originally received a complaint of a disturbance between neighbors in the 23000 block of Straightway, Crestline, shortly after 7:00 p.m. The Sheriff’s Department spokesperson said that by the time the deputies had arrived, the incident had escalated.
The Sheriff’s Department spokesperson told The Alpenhorn News that the initial disturbance was caused when a female neighbor of Hostmark, upset with the manner he was speeding on his motorcycle, started yelling at him for driving too fast in the area. Hostmark allegedly started yelling back at the female, stating that he was a member of the Vagos motorcycle gang and that he was going to kill her. At the same time, Hostmark allegedly pulled an object from his waistband that the victim thought was a gun.
Hostmark was booked at the Central Detention Center in San Bernardino for violation of California Penal Code Section 422, (criminal threats.) Hostmark’s bail was set at $50,000.
Under California law, a criminal threat occurs when a person willfully threatens to commit a crime which will result in death or great bodily injury to another person, with the specific intent that the statement is to be taken as a threat and thereby causes that person reasonably to be in sustained fear for his or her own safety or for his or her immediate family’s safety, even if there is no intent of actually carrying it out.
The Sheriff’s Department spokesperson declined to confirm or deny Hostmark’s claim of membership in the motorcycle gang.
According to documentation obtain by The Alpenhorn News from the San Bernardino County Superior Court; charges of criminal threats have been filed by the San Bernardino County District Attorney’s Office. Hostmark’s new bail was set at $175,000. No additional court information was provided.
If convicted of criminal threats, as the sole conviction, the maximum penalty is imprisonment in the state prison not to exceed four years.
