Vic shooting about respect, court told

A Hells Angels bikie allegedly shot two men outside a Melbourne pub because they disrespected him and his family at a birthday party.

Vince Tominiko, 25, faced Melbourne Magistrates Court on Tuesday where he unsuccessfully applied to be released on bail over a shooting at Hampton Park in November.

Tominiko allegedly shot one man as he lay on the floor in the early hours of November 19 before turning his gun on the man's brother, Detective Senior Constable Luke Valentine told the court.

It's alleged CCTV footage from Hampton Park Tavern shows a fight involving Tominiko's associate began inside the pub during the party.

Constable Valentine said Tominiko was not involved in the fight and was captured on camera leading his friend away from the dispute.
"At that point he looks like he's doing the right thing," he told the court.

Once the 30th birthday party ended and all the guests moved outside, a brawl erupted between 15 males and Tominiko allegedly retrieved a gun from his car.
"The first victim, he gets punched and then shot shortly afterwards," Const Valentine said. Other males were stomping on the second man's head when Tominiko allegedly shot him.

"Whilst he was on the ground being assaulted, Tominiko approached him and shot him twice in the stomach from approximately one to two metres," police allege in a summary. CCTV footage allegedly shows Tominiko's brother and sister trying to grab him in an attempt to stop him.

Tominiko was arrested hours later and allegedly told police he shot the brothers in self-defence. He told police "I didn't intend to hurt anybody" and "I feared for my life", court documents allege.

But Tominiko also allegedly told police the shooting occurred "because they were disrespecting them".

Police say Tominiko described the victims as being "disrespectful to the family".
"Investigators believe the offending was cowardly, extremely violent and unjustified," police said in a summary.
