Final Kingsmen defendants sentenced in RICO case

Former Olean club president sentenced to time served, probation

BUFFALO — Former Kingsmen Motorcycle Club leaders with ties to the area were sentenced Thursday to round out a federal RICO and murder investigation of the club.

Club members Thomas Koszuta was sentenced to serve 57 months in prison, and Robert Osborne was sentenced to time served and three years supervised release.

Osborne, formerly the KMC Olean chapter president, vice president and regular full-patch member, was accused of erasing video footage that showed member Andre Jenkins inside the Olean chapter clubhouse both days before and after Jenkins murdered KMC members Paul Maue and Daniel "DJ" Szymanski behind the North Tonawanda chapter clubhouse on Sept. 6, 2014.

Officials also accused Osborne and Emmett Green of assaulting a fellow member in December 2014 for stealing money from the Olean clubhouse.

Federal prosecutors say that, on June 7, 2013, KMC forcibly shut down its Springville chapter and stripped members of their colors because they were non-compliant members. While others possessed firearms, Koszuta struck a victim in the head with a blunt object and stole items from the Springville clubhouse. They then used bleach to clean areas where the victim bled and cut and removed portions of the rug which contained blood.

Prosecutors said, on Aug. 3, 2013, Koszuta and other Kingsmen members conducted a drive-by shooting targeting former Springville Kingsmen members. Two shots were fired from a shotgun and a vehicle parked near one of the targeted victims was struck.

To date, 16 defendants were charged and convicted in this case, including KMC National President David Pirk and Jenkins, who were each sentenced to serve multiple terms of life in prison.

Pirk and Jenkins were sentenced in February following a four-month jury trial of RICO conspiracy, possession of firearms in furtherance of crime of violence, murder in aid of racketeering, possession and discharge of a firearm in furtherance of a crime of violence, using and maintaining premises for drug dealing and possession of firearms in furtherance of a drug trafficking crime.
